What Is an Exclusive Buyer Agent?

Most real estate agents work with both buyers and sellers — and occasionally both sides of the same transaction. That second scenario, called dual agency, is where conflicts happen. Crystal works with buyers and sellers, but never on the same transaction. When she's your buyer's agent, her full fiduciary duty runs entirely to you.

When Crystal represents you as a buyer, she has a fiduciary duty — the highest standard in Illinois real estate law — to act in your best interest at all times. She must disclose anything she learns that could affect your decision. She must negotiate on your behalf, not split the difference. She cannot represent the seller in the same transaction, ever.

Illinois real estate law (225 ILCS 454): A buyer's agent owes fiduciary duties including loyalty, confidentiality, disclosure, obedience, and reasonable care — but only when there is no conflict of interest. Dual agency legally dilutes those duties. Exclusive buyer representation does not.
